Terms and Conditions

These Terms and Conditions (“Terms and Conditions”) apply to all orders which you, the customer (“you” or “your”) place on this website www.henleygiftcompany.co.uk (“Website”) operated by us, Brook House Trading Ltd trading as ‘Henley Gift Company’ (“we”, “us” or “our”). These Terms and Conditions are governed by the laws of England and Wales.
Nothing in these Terms and Conditions affects your statutory rights, either as a consumer or otherwise.
This legal notice applies to the entire contents of this Website and to any correspondence between us and you. Please read these terms carefully before using this Website. Using this Website indicates that you accept these terms regardless whether or not you decide to purchase from us.

Guarantee

If, for any reason, any of our products do not reach you in good condition, we will happily replace or refund the items concerned. This does not affect your statutory rights as a consumer. Your gift is covered by our money-back guarantee of satisfaction. Please inform us of any problems within 7 working days of receipt of receipt of an order – this period commence the day after the date the gift is received.
Either call us, fax us or e-mail us for an immediate resolution to your problem. If the order is cancelled we will issue a refund within 30 days of cancellation.
Where a gift is to be returned to us for a full refund, we do not accept liability for the return carriage costs incurred. If a return is arranged by us, a refund will be made from the refund to cover the cost of collecting goods.

We will refund your credit/debit card within 2 working days. *If your order has already been despatched you may return it in accordance with our Returns Policy.

Details of after-sales service and guarantees

If you live in the EU you have a right by law to withdraw from the purchase of any item within a ‘cooling-off’ period of seven working days starting on the day after the day the item is delivered to you (“Cooling-Off Period”). This right applies to all items advertised on the Website except:
Perishable goods and other items likely to expire rapidly (e.g. hampers and gift boxes containing such items and other food and beverage items)
Sealed Items where the seal has been broken.

Returns

Items damaged in transit

If you take delivery of a package from us and the contents have been damaged in transit, we will exchange the damaged items without charge to you provided you return the damaged item(s) to us within 30 days of taking delivery

Defective Items

You have the right to return a faulty item within a reasonable period of time

Please inform us of any problems within 7 working days of the receipt of the order.

Costs

We will reimburse any reasonable costs you incur in returning the following items to us:
Items which are damaged upon delivery or are defective or incorrect

You will be responsible for the costs of returning items to us in all other circumstances (including if you exercise your right to withdraw your purchase in the Cooling-Off Period)
Until you return items to us you are responsible for their safe keeping and taking reasonable care of them. We are unable to accept liability for returned packages damaged during transit back to us. It is your responsibility to wrap products adequately to prevent damage.

Losses

We will be responsible for any losses you suffer as a direct result of us breaching these Terms and Conditions if those losses were reasonably foreseeable to both you and us at the time the contract for sale of items by us to you was formed.
We will not be responsible for any to you or any third party for any business loss (including loss of revenue, profits, contracts, anticipated savings, wasted expenditure, data or goodwill) or any loss that does not result directly from our actions or the actions of our sub-contractors or agents, is consequential or was not reasonably foreseeable to both you and us when the contract between us was formed.
Our liability to you under these Terms and Conditions will not exceed the total price charged for the items purchased. Nothing in these Terms and Conditions excludes our liability to you for personal injury or death caused by our negligence.

Events beyond our reasonable control

Neither we, nor any courier or postal service that we use shall be liable for any failure to perform, where such failure or delay results from any circumstances beyond our reasonable control, including, but not limited to any fire, flood, explosion, accident, adverse weather conditions, traffic congestion, mechanical breakdown, obstruction of any public highway, riot, government act, act of war, terrorism, act of God or from any industrial dispute or strike whatsoever.

Substitutions

While photography and descriptions are intended to be accurate, we reserve the right to substitute items of similar or greater value if those stated are unavailable for any reason.

Children

We only sell items to adults (i.e. those aged 18 or over). If you are under 18, you may use this Website only with the involvement of a parent or guardian.

Alcoholic Products

Some of the items available to purchase from this Website contain intoxicating liquor. When you place an order for an alcoholic product using this Website, you confirm that you are aged 18 or over.
